1. Acceptance of Terms

By accessing or using AYLIS ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. Your continued use of the Service constitutes acceptance of these Terms and any future modifications.

2. Description of Service

AYLIS is an AI companion service that enables users to create and interact with personalized AI companions through iMessage. The Service uses artificial intelligence technology to generate responses and simulate conversation.

3. Service Provided "AS-IS"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

You acknowledge and agree that:

  • AYLIS makes no guarantees about the availability, reliability, or functionality of the Service
  • The Service may be interrupted, delayed, or contain errors
  • AI-generated content may be inaccurate, inappropriate, or unexpected
  • We do not guarantee any specific outcomes from using the Service

4. No Refund Policy

ALL PAYMENTS FOR THE SERVICE ARE FINAL AND NON-REFUNDABLE.

You agree that:

  • All subscription fees and purchases are non-refundable under any circumstances
  • No refunds will be issued for partial months of service
  • No refunds will be issued for unused portions of the Service
  • Termination of your account does not entitle you to a refund
  • Dissatisfaction with the Service does not qualify for a refund

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AYLIS AND ITS OPERATORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR:

  • Any direct, indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Emotional distress or psychological harm
  • Damages resulting from AI-generated content
  • Service interruptions or unavailability
  • Unauthorized access to your data
  • Any other damages arising from your use of the Service

YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SERVICE IS TO STOP USING IT.

6. Indemnification

You agree to indemnify, defend, and hold harmless AYLIS and its operators from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any content you submit to the Service

7. User Conduct and Acceptable Use

You agree NOT to use the Service to:

  • Violate any applicable laws or regulations
  • Harass, abuse, or harm others
  • Generate illegal content
  • Attempt to exploit minors in any way
  • Impersonate others or provide false information
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to the Service
  • Use the Service for any commercial purpose without authorization

8. Age Requirement

You must be at least 18 years old to use AYLIS. By using the Service, you represent and warrant that you are 18 years of age or older.

9. Account Termination

We reserve the right to:

  • Suspend or terminate your account at any time for any reason without notice
  • Refuse service to anyone for any reason
  • Modify or discontinue the Service without liability to you

Termination of your account does not entitle you to any refund.

10. AI-Generated Content Disclaimer

You acknowledge that:

  • All companion interactions are generated by artificial intelligence
  • AI responses may be unpredictable, inaccurate, or inappropriate
  • AYLIS is not responsible for any AI-generated content
  • You should not rely on AI-generated advice for important decisions
  • The AI companion is not a substitute for professional mental health services, medical advice, or legal counsel

11. Privacy and Data

By using the Service, you consent to:

  • Collection and processing of your messages and interactions
  • Use of your data to improve the Service
  • Third-party service integrations (iMessage, payment processors)

We will handle your data according to our Privacy Policy, but we cannot guarantee absolute security of your information.

12. Message Access and Monitoring

You acknowledge and agree that:

AYLIS and its authorized personnel may access, monitor, and review your messages and interactions with AI companions for the following purposes:

  • Service operation and functionality
  • Quality assurance and improvement
  • Compliance with legal obligations
  • Prevention of abuse or violations of these Terms
  • Technical support and troubleshooting
  • Safety and security purposes

Security and Confidentiality:

  • Your messages are stored securely using industry-standard encryption and security practices
  • Access to user messages is restricted to authorized personnel only
  • Your conversations are not made public or shared with third parties except as required by law or as necessary to operate the Service
  • We implement reasonable safeguards to protect your data from unauthorized access

No Expectation of Privacy:

While we take security seriously, you acknowledge that:

  • Electronic communications are not completely private or secure
  • You should not share sensitive personal information, passwords, financial details, or confidential information through the Service
  • We cannot guarantee that unauthorized third parties will never gain access to your messages
  • Law enforcement or legal processes may require us to disclose your messages

13. Third-Party Services

AYLIS integrates with third-party services including but not limited to:

  • iMessage (Apple)
  • Payment processors
  • AI service providers

We are not responsible for the practices, policies, or performance of these third-party services.

14. Intellectual Property

All intellectual property rights in the Service, including software, design, and branding, belong to AYLIS. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal use only.

15. Dispute Resolution and Arbitration

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration rather than in court, except where prohibited by law.

You agree to:

  • Waive your right to a jury trial
  • Waive your right to participate in class action lawsuits
  • Resolve disputes individually through arbitration

Arbitration shall be conducted under the rules of the American Arbitration Association.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [YOUR STATE], without regard to its conflict of law provisions.

17. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

These Terms constitute the entire agreement between you and AYLIS regarding the Service and supersede any prior agreements.

20. No Professional Relationship

AYLIS does not provide:

  • Medical advice or mental health services
  • Legal advice
  • Financial advice
  • Professional counseling

The AI companion is for entertainment and companionship purposes only. Always consult appropriate professionals for important decisions.

MANDATORY ACKNOWLEDGMENT

BY CLICKING "I AGREE" OR USING THE SERVICE, YOU ACKNOWLEDGE THAT:

  1. You have read and understood these Terms
  2. You agree to be legally bound by these Terms
  3. You understand the Service is provided AS-IS with no warranties
  4. You understand all sales are final with NO REFUNDS
  5. You waive the right to sue AYLIS for damages arising from the Service
  6. You are at least 18 years old
  7. You agree to resolve disputes through arbitration

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE AYLIS.
